Welcome to Katie Sharpe Images. These Terms & Conditions apply to the use of this website, photography services, galleries, and purchases made through Katie Sharpe Images.

By using this website, booking photography services, accessing a gallery, or purchasing photographs or products from Katie Sharpe Images, you agree to the terms below.

Photography Services

Photography services are provided according to the specific proposal, contract, or agreement provided at the time of booking. The terms of an individual client agreement will apply to that specific service if they differ from or provide additional detail to these website terms.

Payments & Booking

A booking is secured according to the payment and retainer terms outlined in the applicable service agreement.

For standard portrait and session services, a 25% non-refundable retainer is used to secure the date, unless otherwise stated in the applicable agreement.

Remaining balances are due according to the terms provided at booking and must be paid before the photography session or service takes place.

Retainers may be applied toward a rescheduled session when availability allows.

Cancellations & Rescheduling

Cancellation and rescheduling terms vary depending on the type of service and are outlined in the applicable client agreement.

Unless otherwise stated in writing, payments made to secure a date are non-refundable and non-transferable.

For cancellations where a date is subsequently rebooked, Katie Sharpe Images may, at its sole discretion, offer a partial refund of retained amounts. Any such refund is not guaranteed.

Image Delivery & Galleries

Completed images are delivered through an online gallery.

Delivery times vary by service and will be communicated during booking or throughout the photography process. For applicable portrait sessions, galleries may be delivered within 24 hours when promised as part of the service.

Gallery availability varies by gallery type.

School, daycare, sports, organization, and event galleries may remain available for 11 months from the date the gallery goes live. Ordering periods and delivery options may vary by gallery.

Private client galleries may have different availability periods.

Katie Sharpe Images is not responsible for maintaining access to a gallery beyond its stated availability period.

Gallery Access & Passwords

Gallery passwords and access information are provided for the intended client, family, participant, or organization.

Passwords should not be publicly shared when a gallery is intended to provide private access to individual photographs.

For school, daycare, sports, organization, and event photography, gallery access and ordering procedures may differ from private client galleries. Specific instructions will be provided for those galleries.

Photography Products & Orders

Product offerings, pricing, packages, and ordering options vary by photography service and gallery.

Clients are responsible for reviewing their selections and order information before submitting an order.

Orders placed through a third-party professional lab or ordering platform are subject to that platform's processing and fulfillment procedures.

For volume photography galleries, delivery and shipping options may vary depending on when an order is placed and the specific gallery's ordering terms.

Copyright

All photographs created by Katie Sharpe Images remain the intellectual property and copyrighted work of Katie Sharpe Images unless otherwise agreed to in writing.

Purchasing a photograph or digital image does not transfer copyright ownership.

RAW or unedited files are not provided unless specifically agreed to in writing.

Personal Use of Digital Images

When digital images are purchased, the client receives a personal-use license.

Purchased digital images may be:

• Printed for personal use

• Shared with family and friends

• Used for personal keepsakes

• Posted on personal social media accounts

Personal-use images may not be:

• Sold or licensed to another person or business

• Used for commercial purposes

• Submitted for advertising, publication, contests, or promotional use without permission

• Altered in a way that substantially changes the image or removes identifying marks

• Used to create a false representation of the photographer's work or authorship

Copyright remains with Katie Sharpe Images.

Credit when sharing images online is appreciated.

Editing & Artistic Style

Katie Sharpe Images maintains creative control over the artistic style, editing, and final presentation of delivered photographs.

Images are edited according to the photographer's established style. RAW files, unedited photographs, and rejected images are not included unless specifically agreed upon in writing.

Clients may not apply filters, AI alterations, or other edits that substantially change the photographer's finished work and represent the altered image as the original work of Katie Sharpe Images.

Third-Party Printing

Katie Sharpe Images recommends using the professional print products and labs offered through the client's gallery whenever available.

When clients choose to have digital images printed through another provider, Katie Sharpe Images cannot guarantee the color, quality, cropping, paper, or final appearance of those products.

Portfolio & Marketing Use

Katie Sharpe Images may use photographs created during a session or event for portfolio, website, social media, advertising, publication, and other promotional purposes unless the client has provided a written request that their images not be used.

For sessions or projects where images are being held until a specific announcement, publication, or event, Katie Sharpe Images will respect the agreed-upon release timing.

Client Responsibilities

Clients are responsible for providing accurate information, reviewing communications, meeting applicable deadlines, arriving on time, and providing any information needed to complete their photography service or order.

Katie Sharpe Images is not responsible for errors resulting from incorrect information provided by the client.

Liability

Katie Sharpe Images takes reasonable care to protect photographs and deliver contracted services. However, circumstances outside the photographer's reasonable control may occasionally affect the ability to perform a service or deliver images.

In the unlikely event that images are lost, damaged, corrupted, or a contracted service cannot be completed, Katie Sharpe Images' liability will be limited to the amount paid for the affected service, or to reasonable efforts to provide a replacement or alternative service when possible.

Nothing in these Terms & Conditions limits liability that cannot legally be limited under applicable law.

Website Content

All photographs, text, graphics, logos, and other original content appearing on the Katie Sharpe Images website are owned by Katie Sharpe Images or used with permission.

Website content may not be copied, reproduced, modified, distributed, sold, or used commercially without written permission.

Website & Gallery Availability

Katie Sharpe Images makes reasonable efforts to keep the website and galleries available and functioning properly. Temporary interruptions may occur because of maintenance, technical issues, internet service, or third-party platforms used to provide gallery, booking, payment, or other services.

Privacy

Information submitted through the Katie Sharpe Images website, forms, booking systems, galleries, and orders is handled according to the Privacy Policy.

Changes to These Terms

Katie Sharpe Images may update these Terms & Conditions from time to time. The current version will be posted on this page with the date it was last updated.

Terms contained in a specific signed client agreement remain applicable to that agreement.
